What about school placement?

The IEP Team plays a role in determining school placement for the student, based on their plan and needs to meet their educational goals.

What laws or policies that support this? Massachusetts law says that the IEP Team must consider the needs of the student when considering appropriate school placement. This includes special factors, such as English Language Learners.

  • FAPE: "The Team (including the parent) determines the least restrictive environment, or placement that meets the student's needs and provides the services identified in the IEP. This means that the student should attend the school they would attend if non-disabled, unless the Team determines that the student's disability requires a different placement providing the opportunity to have a successful educational experience." (MA DOE Parent Guide to Law)

  • Special Factors - English Language Learners: IEP Team must consider the language needs of the student as it relates to the IEP (Massachusetts Law § 300.324(a)(2)(ii)) and communications needs (ex: direct communication with professional personnel and opportunities for direct instruction in the child's language (Massachusetts Law § 300.324(a)(2)(iv))
